Employment for Business Fees

PROFESSIONAL CHARGES FOR AN UNFAIR/WRONGFUL DISMISSAL CLAIM IN THE EMPLOYMENT TRIBUNAL TOTAL TOTAL (INC VAT)
These estimates are based on the department’s current hourly rates of between £230 and £395 per hour (£276 and £474 including VAT)
Simple case* £12,000 – £16,000 £14,400 – £19,200
Medium complexity* £18,000 – £35,000 £21,600 – £42,000
High complexity* £40,000 – £70,000 £48,000 – £84,000

*There are some factors which could make a case more complex, such as:

  • If it is necessary to defend applications to amend claims or to provide further information about an existing defence;
  • Defending claims that are brought by litigants in person;
  • Making/defending a costs application;
  • Complex preliminary issues such as whether the claimant is disabled (if this is not agreed by the parties);
  • The number of witnesses and documents;
  • If it is an automatic unfair dismissal claim e.g. if the employee is dismissed after blowing the whistle on the employer;
  • Allegations of discrimination which are linked to the dismissal; or
  • Transfer of Undertaking implications.

* Disbursements are costs relating to your matter that are payable to third parties, such as barrister’s/counsel’s fees. We handle the payment of the disbursements on your behalf to ensure a smoother process, however, we do require payment on account from you prior to making any payments on your behalf.
