Pre and Post Nuptial Agreements

Agreements made prior to a marriage, “pre nups”, or during a marriage, “post nups”, are becoming increasingly popular, particularly amongst older couples or those marrying for a second time.

However, despite the extensive news coverage given to these agreements, many people are still unclear about their legal standing and what exactly they can achieve.

Whilst it is currently not possible to prevent a court from considering the financial arrangements in the event of a divorce, as long as certain safe guards are met then these agreements are increasingly being recognised and upheld by courts. It is therefore essential that anyone considering entering into such an agreement, obtains specialist legal advice before doing so.
