Unmarried couples

Increasingly couples are choosing to live together, often in relationships which are as long term and committed as a marriage.  Many have children and buy property together, never thinking of the possible consequences of a breakdown in their relationship. This can leave one or both parties in an unexpectedly vulnerable position, especially in relation to the family home or other property.  Although many people are now aware that the concept of “common law marriage” is a myth, very few are familiar with the complicated legal provisions governing such situations.

We can help you by advising in relation to a joint property purchase or the drafting of a cohabitation agreement, which allows a couple to regulate their financial arrangements both during their relationship, and in the event of a possible future breakdown.  We can also assist in the event of separation, in relation to issues concerning children or finances.  For example, although it is not possible for an unmarried partner to obtain maintenance for themselves from their ex partner, it is possible not only to obtain regular child maintenance payments, but also to obtain assistance for housing any children until their maturity.
