Children

For many separating couples, settling the arrangements for the care of their children is both their first priority and the most emotional aspect of the separation. At Buss Murton we know that children can be very vulnerable to the effects of a relationship breakdown, and with the best interests of any children at stake, it is imperative that we provide parents with expert advice and assistance to help them resolve any issues which may arise, in such a way as to minimise any emotional impact as far as possible.

We are able to advise and assist in relation to all issues concerning children including:

  • Residence and contact arrangements, governing who the child should live with, and arrangements for seeing the other parent;
  • Specific issues, for example concerning education or medical treatment;
  • Applications for leave to permanently remove a child from the UK;
  • Applications by grandparents and step parents who seek increased contact with their grandchildren;
  • Parental responsibility;
  • Financial provision for children including applications under sched 1 Children Act 1989 by unmarried parents for housing or lump sum provision;

We believe that, in the majority of cases, it is better for all the family if an agreement can be reached between parents, thus avoiding the stress and expense of contested court proceedings.  We therefore always attempt, where possible, to deal with issues either through negotiation or through the collaborative process, and can also recommend mediators where appropriate.  However there will always be cases where either negotiations break down or are just not appropriate. In such cases, we will assist and advise parents throughout court proceedings to ensure that these proceed as smoothly as possible.

Sometimes a situation may arise which requires immediate action.  For example, there may be a fear that a child is about to be taken abroad by one parent without the other’s permission. We are experienced in providing the expert advice which is crucial in order to ensure that the appropriate action is taken to deal with these situations.
